Compounded GLP-1s in the Post-Shortage Era: The New Legal Basis Pharmacies Cite

During the FDA-declared semaglutide and tirzepatide shortages, compounding pharmacies had a specific legal safe harbor. When those shortage designations ended, that safe harbor closed — and the compounders still shipping today are operating on a different legal basis. Here's how the ground shifted.

The Shortage Basis, Explained

Section 503A of the FD&C Act generally requires that compounded products not be "essentially copies" of commercially available drugs. Historically, one exception applied during official FDA-declared shortages: a compounded product could replicate a shortage drug without violating the essentially-copies rule.

Semaglutide and tirzepatide were both on the FDA shortage list from 2022 through parts of 2024/2025. During that window, the shortage exception was the primary legal basis for compounded semaglutide and tirzepatide.

What the End of the Shortage Changed

Once the FDA removed the shortage designations, the shortage-basis compounding path closed. Pharmacies that had been compounding on the shortage exception needed to either stop or shift to a different legal basis.

The alternative basis is patient-specific personalization under standard 503A rules: the compounded product must be prepared for an individual patient with a documented clinical basis that the commercial product doesn't meet. This is a real basis — many patients have legitimate personalization needs — but it's narrower than the shortage exception and requires per-patient documentation.

What Pharmacies Now Cite

Post-shortage, compounders that continue to ship semaglutide or tirzepatide typically cite one of a few personalization bases in their intake documentation and prescriber notes. Common bases include: dose personalization outside brand strengths (e.g., 0.35 mg weekly); combination formulations not commercially available (e.g., semaglutide + cyanocobalamin); alternative routes (oral formats); slower titration schedules for tolerance; and excipient-related formulation needs.

Some of these bases are stronger than others. Combination products and alternative routes are the clearest — those formulations don't exist commercially. Dose personalization is legitimate but requires patient-specific documentation on each prescription.

How This Affects Patient Experience

You'll notice the shift in your intake experience. Post-shortage, intake forms ask more detailed questions about your specific clinical situation. Prescriber notes are longer. Your prescription may reference a specific personalization basis. If your platform still uses generic "compounded semaglutide equivalent to Wegovy" language without personalization documentation, that's the platform operating on outdated pre-shortage framing — a signal that hasn't updated to current regulatory ground.

Is This Sustainable?

The patient-specific personalization basis is a sustainable long-term basis for compounded GLP-1s — many patients have real personalization needs and always will. What's not sustainable is compounded GLP-1s as a cheap generic-equivalent to brand product for patients without specific personalization needs. That segment of the market has been contracting, and it should be expected to keep contracting as regulators enforce and prescribers document more carefully.
